Tempo Timor- According to a press released sent by the the VI Government spokesperson office said, “today the Government of Timor-Leste (TL) has given notice to the Government of Australia that it has initiated new arbitration proceedings under the Timor Sea Treaty”. 


The press released continued, “Timor-Leste has initiated this new arbitration to resolve a dispute that exists between the two Governments concerning the proper interpretation of Article 8(b), which arose in early 2014 in the context of an inappropriate interference by Australia in a third-party international arbitration, without prior consultation with Timor-Leste”. 


“Timor-Leste disagrees with Australia’s assertion that it has absolute and exclusive jurisdictional rights, including taxation rights, relating to the entire length of a petroleum export pipeline including into the Joint Petroleum Development Area. Australia’s claim would deny Timor-Leste any jurisdictional rights relating to this pipeline or activities relating to this pipeline. This is inconsistent with the text and purpose of the Treaty and is not supported by any negotiating or other documents that have been brought to light, in particular as it pertains to jurisdiction within the Joint Petroleum Development Area”. 


“Over the past eighteen months Timor-Leste has consistently been willing to discuss with Australia the meaning of Article 8(b), and to acknowledge the shared nature of jurisdiction that the Timor Sea Treaty establishes as part of the compromise necessary to permit the temporary arrangement allowing each party to benefit from the exploitation of the resources in the still-disputed area. On this basis, Timor-Leste has invited consultations on the scope of each party’s jurisdiction to determine where it is shared, where it is exclusive to Australia and Timor-Leste, and where it is yet to be determined. Its efforts in this regard have been to no avail,” the statement said. 


“Given the inability to discuss the degrees of jurisdiction in the disputed waters, Timor-Leste is now of the view that the only way to resolve this matter is by submitting the dispute to an arbitration Tribunal as provided for under Article 23 of the Treaty. The initiation of arbitration will allow for each party to present its position supported by facts and law”. 


“Timor-Leste remains willing to resolve the dispute directly with Australia. This will be possible if Australia can help break the current impasse by recognizing the existence of shared jurisdiction, according to the terms of the Timor Sea Treaty, and engage in productive consultations to determine the degree of each nation’s jurisdiction over the shared pipeline and related activities”.


“Timor-Leste is hopeful of the satisfactory and speedy resolution of this matter.”

Exclusive Interview Between two Joses:  Jose Antonmio Belo (Jose Belo) and Former President, Jose Ramos Horta (JRH) to discuss so many important issues happening in the World and Timor Leste.

DR. Ramos Horta talk about the high level panel reports, the boat people to Australia and the Rohingya issue including what to do to get Australia to seat with East Tinor to negotiate the maritime border between the two country.

Lets us follow the exclusive interview as below:

Jose Belo:  Thank you sir, My first question is about the report from high level panel submitted to the UN Security council. Can you explain what is about?

JRH: In October last year 2014, the Secretary General decided to establish a high level panel to review the United Nation Peace and Security Operation. In November I was appointed by the Secretary General as a Chair of this high level panel comprising 17 personalities from around the world representative of the regions with very rich background in peace and security, in governance, in politics and etc. Normally such a mandate should last a minimum of 1 year but because of time pressure, the Secretary General asked us to conclude in less than 9 months. We concluded in 8 months. We began working end of November and June 16 in New York I handover the report to the secretary General. The report has been widely praised and commended by everyone, by the Secretary General himself, members of Security Council and the members of the UN General Assembly. And what have we purposed? Obviously first let me say that the United Nations and the international community have limited ability to prevent and end wars, because wars sometime they happen out of the blue, sometime we know, we expect, anticipate a conflict but difficult to take action before a conflict erupt. Sometime a conflict erupts without anyone be able to deal with that because elements on the ground, people on the ground with their pride, their prejudices, their ambition, their personalities, their egos, their allegiances, all come into play and very difficult to bring parties to a conflict negotiating table. Look at Syria, attempts by the United Nations and the Arab League, look at the case of South Sudan ongoing, so it’s extremely difficult but we have to try. So we have recommended that the United Nations and international community in general develop more strategies supported with resources in enhancing the preventive diplomacy mechanism. That we must do more to prevent wars rather than waiting for wars to occur and then try to negotiate end of the wars. We also argue that international community particularly the rich countries can do more and must do more to equip the United Nations Peacekeeping with better resources. For instance, in Africa there are good soldiers, good officers, many are actually outstanding, they have battle experiences, it is the African Union without much help from the international community that confronted extremist elements in Somalia. They are still there fighting and dying, peacekeepers from Ethiopia, from Kenya, Uganda, etc. Much of the forces deployed in Congo, South Sudan also originate from African countries, of course from Asian regions as well. However, many of these African countries have very limited capabilities in terms of logistics, airborne capabilities, sea base capabilities or land base capabilities to move fast, to deploy troops, to deliver goods, etc. So there has to be a strong partnership between the United Nations, regional organizations and countries like Japan, some Europeans that might not be able to deploy troops because of their law, their constitution but they can deploy engineering battalions, they can deploy equipment, helicopters, troops transport planes, etc. So we look in all of these, how the UN can first; be more effective in preventing wars. We provided solution, ideas, recommendation and then when a conflict occurs, how the peacekeepers can better be assisted in terms of having the adequate logistic support of equipment, helicopters, vehicles, airborne capabilities to fulfill their responsibilities.

Jose Belo: Your Excellency, can you explain a little a bit, what are the weaknesses of the United Nations so far, why was the high level commission established?

JRH: The weaknesses are that they inherited in a multilateral organization. Easier when you are a member state, you have your President, Prime Minister, the Parliament, you have Defense Minister, the Minister of Interior, they make their decisions and there is no much more complication. You have resources or you don’t have resources, but the UN is a constellation of 194 States. And when there is need for a peacekeeping operation, after the peacekeeping has been authorized, mandated by the UN Security Council, the Secretary General starts calling member states to offer troops, police to this operation, let’s say South Sudan or Mali. Because the UN doesn’t have a standing army, it has to depend on troop contribution and the financial support from the Security Council 5 permanent members. So this is one and when you have troops from so many countries, very difficult to have a chain of command that is absolutely disciplined and strict because the temptation is a particular battalion, particular commander from a particular country, they listen to their leaders back in their country and sometime not to the forth commander in the field. Some time not to special representative of Secretary General, so we addressed all of this, that there has to be clear unchallenged chain of command, clear authority vested on the special representative of the Secretary General and on the forth commander and not on the colonels, the generals that are from each of the countries contributing troops to the UN.

Jose Belo: Moving on to the other issue, to the issue in Myanmar. There are people smuggling boats and there is some reports says some mass graves were found in the bushes from Myanmar to Thailand on to Malaysia. What do you think about this whole issue?

JRH: It is a catastrophe what is happening with Rohingya in Myanmar. I do not wish to criticize the government there or Madam Do Aun Su Chi. They are all facing extreme difficulties. We all know from our experience in Timor Leste, the experience in Indonesia when you transition from a dictatorship like the Indonesian did in 1997-98. There were tumultuous developments in Indonesia, religious, ethnic violence, etc. But in the end, Indonesia came back together, prospering, very stable and respected internationally. Myanmar is going to the same experiment with transition to democracy but the difficulty with Myanmar is that they have dozens of ethnic groups, very distinct and each of the ethnic group has for the case develop their own armies fighting the central government. They have made tremendous effort in trying to break ceasefire and they have succeeded but the question now is of disarmament and the cantonment or returning of these insurgences to civilian life etc. This will take many many years. At the same time, they have this ethnic and religious problem. The problem is not only with Rohingya which is an ethnic minority of Bengal extraction but who have been living in Myanmar for generation. So they are Burmese like anyone else in Myanmar. But there are also problems with muslim in general, several million muslims who are in Myanmar, they are also under threat, they are discriminated, they are threatened etc. So the problem is not only against Rohinya. The Rohinyas are the extreme case of the discrimination, exclusion and violence. But the violence also affects the rest of the muslim population. And that can create new security problem because it is already inciting extremist muslims elsewhere in the region or in the middle east to show solidarity with the prosecuted muslim in Myanmar.  So a problem that could be resolved in Myanmar proper through dialog, through compassion to bring together all the ethnic groups and religious groups in Myanmar can become a major security challenge in South East Asia. As I said totally understand and sympathetic to the challenge faced by the President, Su Chi, what I suggest is that they all should sit together Su Chi, the President, the army, religious leaders, the monks and muslims to defuse the tensions in Myanmar. The burden cannot be only on the shoulders of the president or on the shoulders of Su Chi. So I don’t agree with the criticism directed at Su Chi, that she is not speaking out, denouncing the violence against Rohingyas. She is being careful trying to manage a very volatile complex situation.

Jose Belo: As you know these people they are boat people from Myanmar to Australia. In some cases, some of them have been through hell and then sent afterward to detention centers in Australia once they entered Australian water, what would you think about the Australian government attitude toward the boat people?

JRH: Yeah, so the Rohingya problem has now become a regional problem because of the people smuggling, some people they flee in desperation because of the violence inside Myanmar, instigated by groups in Myanmar because of exclusion, poverty, denial of citizenship. These people have nothing to lose, so they are vulnerable to unscrupulous smugglers who are extorting money from them and try to take them to wherever they can go. These people, they are desperate, they are not thinking of a rosy life in Australia, they would go anywhere, so they go to Indonesia, they go to Malaysia, they go to Thailand and thanks god the Philippines show high decency, morality, ethic and they welcome them. We must praise Philippines, you know, that great country that face so many problems of their own, social, economic but also natural disasters and yet they were the first from ASEAN to welcome them. I am very disappointed with the absolute lack of compassion and leadership shown by Australia in this regard. We know that Australia has to be prudent in managing the inflow of the refugees into Australia. Australia has been welcoming immigrants for generations but we are dealing with urgent situation. We are dealing with emergencies. We are dealing with hundreds of people with life at stakes. So you cannot just simply provide bribes to people smugglers to take back the victims, the rohingyas to Indonesia. This is absolutely unheard of, I never heard of any country that has done that. You know, pay money to the smugglers to take back to wherever they came from or to take them to another country. So hope that Australia, understanding the challenge that Australia faces, they have to find a regional solution and the Bali platform, the Bali process provides the forum to address the challenge but they have to proactive, they have to be generous and I agree solution has to be found in Myanmar. Myanmar has vast land, incredible resources, so Myanmar authority has live up to their responsibilities. They cannot dump these people on their neighbors. Countries like Malaysia, Thailand, Philippines, Indonesia are the ones on the front line managing the impact of the problems in Myanmar.    

Jose Belo: I am moving on to the other issue in regards to Australia and East Timor relationship. As far as we understood, there was a meeting to setting up a commission to negotiate with Australia on maritime boundary. What would you tell us about it?

JRH: Yesterday was just a formal inaugural meeting of the maritime commission which comprises is chaired by the Prime Minister himself and former Presidents of the republic, former prime ministers, or speakers of national parliament. Each of us has our own experience and knowledge, wisdom to share and on how we can advance our strategic interests. And what are our strategic interests? To resolve once and for all the maritime boundaries between us and Indonesia, between us and Australia. And that is normal, any coastal country, maritime country has the right to international recognized maritime boundary. The easiest would be for Australia to agree to the medium line between Australia and Indonesia because the argument on the continental shelves is outdated; it is not acceptable anywhere in the world. Only the old powers still want the continental shelves. It is acceptable when it doesn’t infringe upon another coastal state, like Portugal extending its exclusive economic zone its continental shelves because nothing else in front of Portugal, after Portugal you have United States, you have Canada, so you have the vast Atlantic ocean,  so it a metaphor Portugal to resolve that. But when you have coastal states facing you, the best simple is under international law, law of the sea, is a medium line. Australia has refused to honor the medium line principle as established in the law of the sea. However, Australia is a friend of Timor Leste, they have helped us a lot throughout the last 10 to 15 years, Australian people are being incredibly generous toward Timor Leste. Timor Leste and Australia share strategic interest in terms of maintaining peace and security in Timor Leste and the region. Timor Leste has contributed enormously internationally. So I believe it is possible for Canberra to rethink its policy, its strategy and sit down with us and agree on delimitation of our maritime boundry.

Jose Belo: But the Australian keep rejecting, what are you going to do to convince them to sit with you to negotiate this problem of maritime boundary?

JRH: I believe it is possible to reach an agreement with Australia that satisfied Timor Leste national interests, its legitimate rights and Australia’s interests. Diplomacy was invented precisely to resolve disputes, conflicts and differences between states, particularly friendly states and neighbors. The maritime commission in which I am a member is just a starting, we simply provide advice to the government and the government then instructs its negotiators to deal with it. But at the same time, each of us participating in the commission, we will share our ideas within the commission to see what we can do advance our interests. And our interests are very simple, very clear; we want a defined maritime boundary. The decision made in 2005 to postpone the delimitation of maritime boundary for a number of years presupposes in good faith negotiation and presupposes a fair deal and fair deal would have included the pipeline from the Greater Sunrise would come to Timor Leste. Not only that the CMAT and the arrangement on resources sharing on Greater Sunrise was in fair to Timor Leste but on top of it Australia wanted also the pipeline to go to Darwin or at least not to come to Timor Leste. So besides an arrangement of postponing maritime boundary, a revenue sharing agreement that is unfair to Timor Leste on top of it Australia wanted the pipeline to go to Darwin. This is what you call particularly in any language but particularly for the Anglo-Saxon and Anglo-Saxon are known to be fair minded, what is fair in Anglo-Saxon culture, I wouldn’t say Australia is an anglo-saxon country because I pay tribute to the many millions of non anglo saxon who are there;  Italians, Lebanese, Maldives, Greeks, Portuguese and increasing number of Chinese. But Australia in general is a fair country and they should understand the interests, the rights of Timor Leste. So I believe it is possible to work out an agreement in due course. Our government has had contacts with Foreign Minister Julie Bishop and I believe that Australia will realize that it is unsustainable for Australia, for its credibility, it image, its good name to maintain this unfair situation.  

Jose Belo: You are going to finish your mission with the United Nations soon and already there is speculation that you are going to join PD or Democratic Party. Is that true?

JRH: No. I visited PD yesterday to pay tribute to Lasama and also to the leaders to encourage them, to tell them please unite. Lasama was a great leader founder of the party, RENETIL and they all have responsibility to honor his legacy and reorganize the party, more dynamic because democracy in Timor Leste needs PD. We shouldn’t have too many political parties but we shouldn’t have too few. So PD is a very important party of our democratic culture, democratic institutions. I am happy to help them but I am happy to help any political party by talking to them sharing my experience, advising them on politics, on strategies, on leadership issues etc. That’s all I can do, you know, I meet with all the political parties and I will be meeting with them. So I have no plans to join any political party in Timor Leste but I will assist in helping any party in terms of understanding democracy, understanding leadership and give them ideas how they can communicate better their own ideas to people etc, so that’s my interest.

Jose Belo: So even there are some talks within PD that they are going to nominate you to run for the leadership of PD because there is no body fit for the leadership of the party. What do you say about that?

JRH: Well they do have some good qualified people and I couldn’t mention name but I know few of them and they are good. They just need first unity, that whoever they choose everybody must be behind and then people like me, Xanana, we have obligation to encourage them to support because PD is already established, one of the parties that survived the 2012 election and I believe they will succeed more in 2017 if they rejuvenate, if they renew and they resolve leadership challenges.

Dili, Tempo Semanal - Kepala Fungsi Politik Kedutaan Besar Republik Indonesia untuk Timor-Leste menyatakan bahwa pihak Pemerintahan sudah mengusulkan kepada Pemerintah Republik Demokratik Timor-Leste untuk memulai perundingan tentang batas kelautan antara kedua Negara.
“Kami sudah mengusulkan”, kata Djatmiko, Kepala Fungsi Politik kedutaan Besar Republik Indonesia di Dili kepada Tempo Semanal.

Kepala Fungsi Politik Kedubes RI di Dili itu menekankan bahwa pihaknya sedang menindaklanjuti keseriusan Pemerintahan President Joko Widodo untuk menyelesaikan masalah perbatasan kelautan dengan semua negara yang bertetangga langsung dengan wilayah Laut Indonesia termasuk perbatasan kelautan Republik Indonesia dengan Republik Demokratik Timor-Leste.

“Kami sudah pernah mengusulkan tetapi dari pihak Timor-Leste sendiri belum memberikan tanggapan secara pasti. Kami sudah mengirim nota juga, agar nantinya dalam Joint Border Committee  (JBC) itu ada satu sesi tersendiri untuk membahas mengenai awal perbatasan laut, akan tapi pihak Timor-Leste belum memberikan respons atau belum memberi tanggapan”, ungkap Djatmiko.

Lebih lanjut beliau menerangkan bahwa, “memang kita sejak JBC tahun lalu itu memang sudah meminta paling tidak itu sudah mulai di bicarakan dalam JBC nanti waulaupun belun membahas secara detail.”

Timor-Leste memiliki batas laut dengan dua Negara yaitu bagian utara dan sebagian kecil di wilaya Timur dan barat selatan perbatasan langsung dengan Perairan Indonesia dan bagian selatan Timor-Leste berbagai perbatasan laut dengan Australia. Namun dalam hal Perundingkan Perbatasan Laut baru pihak Jakarta sudah mengirim nota ke Dili untuk melalukan perundingan tentang batas wilayah kelautan antara kedua Negara.

 “Semua perbatasan itu prioritas pak Jokowi supaya diselesaikan perbatasan darat maupun laut”, Kepala Fungsi Politik Kedus RI di Dili, menegaskan.
 “Saya kira semua wilayah perbatasan laut akan di bahas”.

Semenjak Timor-Leste memisahkan diri dari Indonesia lewat referendum pada 30 Agustus 1999, kedua Negara sudah menyelesaikan sebagian besar perbatasan darat dan yang tersisa hanya dua segmen di enclave Oekuse dan Nusa Tenggara Timur (NTT). Namun kedua Negara belum membahas perbatasan Laut sehinga pada pertemuan perdana antara Duta Besar (Dubes) RI untuk Timor-Leste di Dili, Primanto Hendrasmoro dengan Perdana Menteri Baru Timor-Leste, DR. Rui Maria de Araujo juga sempat menyinggun masalah perundingan batas kelautan.

“Saya juga melaporkan beberapa berkembangan baru termasuk bagaimana kita berusaha agar dua segmen perbatasan darat itu bisa terselesaikan dan bagaimana kita bisa memulai membahas juga atau merundingkan mengenai batas wilayah laut (Maritime Border)”, kata Dubes RI, Primanto Hendrasmoro  kepada wartawan setelah pertemuannya dengan Perdana Menteri Rui Maria de Araujo di gedung Pemerintahan di Dili, baru-baru ini.

Sebelumnya dalam wawancara esklusif dengan Tempo Semanal di Dili, Dubes Primanto menyampaikan bahwa pihaknya sudah mulai melakukan pertukaran pikiran mengenai Indonesia yang merupakan Negara kepulauan. Sebagai Negara Kepulaun juga ada prinsip-prinsip tertentu harus di pakai di negara kepulauan yang atur di dalam konverensi Perserikatan Bangsa Bangsa mengenai hukum laut tentang bagaimana menarik garis batas dan sebagainya. Hal ini juga sudah di pikirkan supaya pada saat perundingan di mulai setidaknya sudah ada sebuah kesamaan persepsi.

“Sebenarnya sudah ada kesepakatan pada putaran JBC sebelumnya untuk memulai satu penjajakan untuk merundingkan batas maritim. Kita belum sampai pada sebuah perundingan yang betul-betul tetapi sebenarnya bertukaran pikiran mengenai berbatasan maritime sudah di lakukan.” Dubes primanto mengatakan dalam wawancara esklusif yang di terbitkan oleh Tempo Semanal baru-baru ini.

“Saya kira ini juga, perbatasan laut tantangannya akan lebih besar. Kita ingin membangun sebuah pendekatan baru untuk mulai merundingkan perbatasan laut”, kata Dubes RI kepada Wartawan Tempo Semanal.

Di samping itu menurut Primanto bahwa pihaknya dan phiak Timor-Leste sekarang ini ingin iuga mengembangkan apa yang sesuai dengan kesepakatan peraturan mengenai pelintasan batas, itukan seperti kita ketahui selain upaya untuk menyelesaikan garis batas itu, juga di kembangkan hubungan interaksi antara masyarakat perbatasan, antara lain membangun sebuah rezim pelintasan batas yang legal dan damai untuk menumbuhkan hubungan-hubungan sosial dan ekonomi.

Terkait dengan kelautan, sekarang kita berpikir selain membukakan sembilan pintu titik pelintas batas yang ada di darat itu, kita juga sekarang berpikir mencoba karena itu satu hal yang baik juga mengembangkan titik pelintasan yang di laut. Misalnya antara pulau Alor dengan Timor-Leste. Jadi mereka yang tinggal beberapa kecamatan di pulau Alor bisa melintas kesini.

Pemerintahan RI sangat serius untuk memulai perundingan dengan Timor-Leste sehingga masalah perundingan batas laut antara kedua negara juga akan dibicakan dengan Menteri Luar Negeri Timor-Leste, Hernani Coelho apabila berkunjung ke Jakarta untuk menghadiri Konferensi Asia Afrika nanti.
 “Rencananya Menteri Luar Negeri Timor-Leste akan berkunjung ke Jakarta dalam rangka menghadiri Konferensi Asia Afrika nanti akan di bicarakan juga karena kita usulkan agar di singgung juga masalah tersebut”, kata Djatmiko.

Disisi lain Perdana Menteri Timor-Leste Rui Maria de Araujo dalam pidato perdana saat pelantikan dirinya sudah mengungkapkan prioritas yang sama untuk menyelesaikan perbatasan laut dengan Indonesia dan Australia.
